These Terms of Service ("Terms") govern your use of the website visaro.ca, our online booking platform at order.visaro.ca, and the real estate photography, videography, and media services provided by Visaro, a trade name of VUMEDIA ("Visaro," "we," "us," or "our"). By booking a service, accessing our website, or using our booking platform, you ("you," "client," or "agent") agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website, booking platform, or services.

1. Our Services

Visaro provides professional real estate photography, videography, floor plans, virtual tours, drone aerial media, and related digital marketing services for residential properties across the Greater Toronto Area. Specific services, package inclusions, pricing, and delivery timelines are described on our website at the time of booking and may be updated from time to time.

2. Booking and Scheduling

• Bookings are made through our online storefront at order.visaro.ca/storefront, by phone, or by email.
• A booking is confirmed once you receive a confirmation email or text message from Visaro.
• You are responsible for providing accurate property address, access information, and contact details at the time of booking.
• Travel fees apply for properties located outside our core Zone 1 service area, as outlined on our Service Areas page. Zone 2 properties incur a flat travel fee, confirmed at the time of booking.
• Same-day or rush bookings are subject to availability and may incur additional fees.

3. Property Access and Readiness

To ensure the best results and avoid delays or rescheduling fees, please ensure the following before our arrival:

• The property is clean, decluttered, and staged to your satisfaction.
• We have confirmed access to the property at the scheduled appointment time, including any lockbox codes, keys, or access instructions.
• All occupants and pets are informed of the scheduled shoot.

Visaro photographers and videographers do not move furniture, personal items, or perform staging services unless virtual staging or a specific staging add-on has been purchased separately. If our team is unable to access the property at the scheduled time, a rescheduling fee may apply.

4. Cancellations and Rescheduling

Visaro reserves the right to reschedule a shoot due to severe weather conditions affecting exterior photography or safety, equipment issues, or other circumstances beyond our control. In such cases, we will work with you to find the next available appointment time at no additional charge.

5. Payment and Pricing

• All prices listed on our website are in Canadian dollars (CAD) and are subject to applicable HST unless otherwise stated.
• Payment is processed securely through our online booking platform at the time of booking, or invoiced separately for established clients under a post-delivery billing arrangement.
• A tax invoice will be provided with every order.
• Add-on services selected after booking will be billed in addition to the original package price.
• Prices are subject to change. The price confirmed at the time of booking will be honoured for that specific appointment.

6. Delivery of Media

• Standard delivery timelines are as stated on our Packages & Pricing page at the time of booking (typically 48 hours for most packages, 72 hours for the Elite package).
• Rush delivery (next-day 9AM) is available as a paid add-on, subject to availability.
• Delivery timelines begin from the completion of the on-site shoot, not from the time of booking.
• Media is delivered digitally via download link, branded property webpage, or as otherwise specified in your selected package.
• The number of edited photographs included in each package (e.g., "up to 25 photos") represents the maximum number of images typically delivered. The final number of delivered images depends on the size, layout, and unique features of the property, and is not guaranteed to match the stated maximum in every case.

7. Copyright and Usage Rights

Under Canadian copyright law, Visaro (VUMEDIA) retains copyright ownership of all photographs, videos, floor plans, virtual tours, and other media created in the course of providing our services, unless otherwise agreed to in writing.

Upon full payment, the client (the real estate agent, brokerage, or property seller who booked the service) is granted a non-exclusive, royalty-free license to use the delivered media for the following purposes:

• Listing the property on the MLS (Multiple Listing Service) and TRREB.
• Marketing the specific property on social media, websites, print materials, and email campaigns.
• The agent's or brokerage's own self-promotion in connection with that listing.

This license does not permit:

• Resale, sublicensing, or redistribution of the media to third parties not involved in the original transaction, without Visaro's written consent.
• Use of the media for purposes unrelated to the marketing of the specific property photographed.
• Use of the media by a different agent or brokerage after a listing changes hands, without first obtaining permission from Visaro.

Visaro reserves the right to use any media created for portfolio, marketing, and promotional purposes, including on our website and social media channels, unless the client requests otherwise in writing prior to the shoot.

8. Blue Sky Guarantee

Our Blue Sky Guarantee means that exterior photographs delivered to you will feature a clear blue sky, regardless of actual weather conditions at the time of the shoot, through standard post-production sky replacement included in every package at no additional charge.

9. Revisions and Satisfaction

If you are not satisfied with the quality of your delivered media, please contact us within 5 business days of delivery. We will work with you to address reasonable concerns, which may include minor re-edits at our discretion. Re-shoots due to client dissatisfaction with subjective stylistic preferences (rather than technical errors) may be subject to an additional fee.

10. SMS and Email Communications

By providing your phone number and email address during booking, you consent to receive appointment confirmations, booking reminders, and order delivery notifications from Visaro via SMS text message and email, in accordance with our Privacy Policy and Canada's Anti-Spam Legislation (CASL). You may opt out of SMS communications at any time by replying STOP to any message. Standard message and data rates may apply.

11. Limitation of Liability

Visaro will perform our services with reasonable skill and care. However, to the fullest extent permitted by Ontario law, Visaro's total liability for any claim arising from our services is limited to the amount paid by the client for the specific service giving rise to the claim. Visaro is not liable for indirect, incidental, or consequential damages, including loss of business opportunity, loss of a sale, or delays caused by circumstances beyond our reasonable control, including weather, property access issues, or third-party platform outages (including our virtual tour hosting or booking platform).

12. Drone and Aerial Services

Aerial drone photography and video services are provided in compliance with Transport Canada regulations. Drone services are subject to airspace restrictions, weather conditions, and property/neighbourhood suitability, and may be unavailable or rescheduled for reasons outside our control, including proximity to airports, restricted airspace, or unsafe flying conditions.

13. Third-Party Platforms

Our online booking, payment, and virtual tour hosting services are provided through third-party platforms. While we select reputable providers, Visaro is not responsible for outages, errors, or data handling practices of these third-party platforms beyond our reasonable control. Each third-party platform's own terms of service and privacy policy may also apply to your use of those platforms.

14. Service Area and Travel Fees

Visaro provides services across the Greater Toronto Area, divided into Zone 1 (no travel fee) and Zone 2 (flat travel fee applies), as detailed on our Service Areas page. Properties located outside our standard service area may be accommodated on a case-by-case basis with a custom travel fee quote.

15. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, business practices, or applicable law. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our website, booking platform, or services after changes are posted constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Ontario.
